Regulatory protection

The RCIC standard of care: why regulated counsel matters

In Canadian immigration, who represents you affects what protections you actually have. Here is the difference, in plain terms — check any representative's standing on the CICC Public Register before you pay anyone.

Regulated counsel

An RCIC or lawyer authorized under IRPA section 91

  • Authorized representation: Under section 91 of the Immigration and Refugee Protection Act, only lawyers, RCICs, and certain other authorized representatives may advise on an immigration application or represent an applicant for a fee.
  • Accountable to a regulator: RCICs are licensed and disciplined by the College of Immigration and Citizenship Consultants, and must meet its Code of Professional Ethics and continuing-education requirements.
  • Verifiable status: Anyone can confirm a consultant's standing on the CICC Public Register, and a formal complaints process exists if a client believes standards were breached.
  • Named on your file: An authorized representative is declared on the use-of-a-representative form for your application, so it is clear who is acting for you and who is accountable.

Anyone can check a consultant's standing — including ours — on the CICC Public Register before paying anyone.

Unregulated “ghost” agents

Overseas brokers and intermediaries without Canadian authorization

  • No legal standing: Someone who is not authorized cannot lawfully represent you, advise you for a fee, or communicate with IRCC on your file.
  • Misrepresentation exposure: Filings prepared by unauthorized intermediaries are a common source of inaccurate or unsupported documents, and a finding of misrepresentation under IRPA section 40 can bar entry to Canada for five years.
  • No regulatory recourse: With no licensing body involved there is no disciplinary process, no professional complaints route, and no standards enforcement to fall back on.
  • Unprotected payments: Fees paid to an unaccountable third party offer no regulated protection and no structured route to recovery if nothing is delivered.

Questions that come up before you commit

Strategy questions we are asked most often, answered the way we would answer them in a consultation.

Often, yes. Canadian law expressly contemplates dual intent: you can apply for a temporary resident visa or permit while also intending to seek permanent residence, provided your temporary application is genuine on its own terms and you can show you would leave if your status ended. What we check is whether the streams support or undermine each other on your facts — for example, how a study or work application sets up a later Express Entry profile.

You usually cannot tell from a checklist alone, because streams depend on facts that interact: your work experience and its classification, language results, education credentials, funds, family ties, and any prior refusals. A consultation is where we test those facts against the program requirements and tell you which streams are realistically available now — including when the honest answer is that a different stream, or waiting, is the stronger path.

Yes, and planning around a single snapshot of them is a mistake. IRCC publishes current processing times per application type, and its annual Immigration Levels Plan sets intake targets that shift cut-offs and queues. We work from the requirements that apply to your application and tell you where timing is genuinely uncertain rather than quoting a number that will go stale.
